The state Chamber of Commerce wants to file a friend of the court brief with the state Supreme Court, supporting a challenge to a new fee that would go to the state Medicaid program.

     Insurance Commissioner Kim Holland says the fee is unconstitutional.

     A new law set to go into effect later this month would impose a 1% charge on health claims.

     Holland says the charge is a tax that was passed within the last five days of the 2010 legislative session by less than three-quarters of the Legislature.
