The state Supreme Court on Thursday denied a request by the State Chamber of Commerce to join Insurance Commissioner Kim Holland's constitutionality challenge of a one percent charge on health care claims.

 

     The money would go to the state's Medicaid program.

 

     The Court has not decided whether it will hear Holland's lawsuit.

 

     She contends the charge is a tax that was approved by less than three-quarters of the Legislature less than five days before the end of the 2010 session.

 

     Unless the state's High Court rules otherwise, the new law takes effect Aug. 27.
